The United States (US)
and the European Union (EU) have recently enacted unilateral trade-restrictive
legislation on the basis of environmental and labour protections in exporting
countries, including broadening the scope of anti-dumping and countervailing
duty laws. Although not a new phenomenon, the historical overview suggests the
incorporation of environmental and labour standards within the multilateral
trading system as opposed to unilateral action.
