The question of third party liability has been on the working programme of the ICAO Legal Committee since 2000. A first draft with the view of modernizing the 1952 Rome Convention on Damage Caused by Foreign Aircraft to Third Parties on the Surface was developed by a Study Group and submitted to the 32nd session of the Legal Committee in March 2004.
