It would appear that with every holiday season and every airline insolvency consumer watchdogs reiterate their call for the introduction of an aviation bankruptcy regime to help stranded passengers return safely and have their air fares refunded if an air carrier has to cease operations due to financial difficulties. In this paper the authors look at the legality of various regulatory options from the perspective of European and international law and come to the conclusion that a funds solution would be a violation of international law and that other forms of relief or protection are neither necessary nor helpful.
