On 10 April 2010, Flight PLF 101 crashed near Smolensk 'Severny' Airport Russian Federation during a trial approach in bad weather and low visibility, killing eighty-nine passengers and seven crew members. It transported the President of Poland, with his retinue and fourteen civilians. Since neither the 1999 Montreal Convention nor the European Union Regulation (EC) No 889/2002 are applicable in the resolution of the damages incurred by PLF 101 victims' families, it is Polish Air Law that applies. The article will examine the question of civil liability for damages caused to passengers of the PLF 101 flight under Polish Law.
