Breaking with international jurisprudence, the Court of Justice of the European Union ruled that pure psychological injuries could be compensated under the 1999 Montreal Convention in Laudamotion (C-111/21). Claimants would have to demonstrate, however, that the psychological injury seriously affects their state of health and needs medical treatment.
