We
feature, in this issue and the next, the whole of the practice arbitration conducted
on February 14th, in Aberdeen, by the Scottish Branch. In this issue we
reproduce the preliminary correspondence and also the Pursuers' case. In October,
we shall reproduce the Defender's case. All readers, with the exception of
those who attended the practice arbitration, are invited to write to the
Editor, after having read the October issue, with the Form of award and reasons
which they would have given. The contribution which most nearly accords with
the actual award and reasons given by the arbitrator, will be published in a
later issue and the contributor will be sent a modest prize !
In
order to give an introduction to arbitration in Scotland, the following article
on differences between Scots and English law in arbitration is reproduced from
the Estates Gazette by kind permission of the Editor.
