Hong Kong has adopted the NEC3 contracts in the government sector for almost a decade. The three pillars of NEC3, namely simple language, stimulation of good project management and a spirit of partnering relationship are designed to reduce conflicts and disputes in the construction industry. This case review evaluates some recent judgments in other jurisdictions with an aim to facilitate NEC3 users in Hong Kong. The selected cases relate to the metric of defective works, order of precedence, unforeseen physical conditions, payment in target cost contracts, and reversal of compensation events.
