In this article, the author contends that the parallel jurisdiction conferred by statute on arbitrators and the courts to grant interim measures of protection, whilst intended to promote flexibility, lacks clarity in its application. This is particularly the case where a party seeks ex parte interim relief from an arbitral tribunal.
