This article explores the potential of commercial arbitration and mediation in resolving shareholder disputes by reference to the Anglo-American experience of court-annexed ADR. It argues that effective judicial case management, allied to a well-administered, thoughtfully designed and robustly implemented ADR scheme, can provide an answer to the problems posed by lengthy and costly shareholder litigation.
