This article examines approaches to the enforceability of negotiation and mediation clauses in Hong Kong and Singapore, by reference to decisions from not only those jurisdictions but also England & Wales and Australia. It concludes with some tips on drafting these clauses in order to avoid uncertainty in their implementation.
