This article compares and contrasts the concepts of facilitative and evaluative mediation, drawing attention to the fact that mediators are often required to apply these methods in a ‘mixed process’ rather than following an approach of one to the strict exclusion of the other. It is an edited version of a paper given by the author to the Hong Kong Institute of Arbitrators’ Seminar on Evaluative Mediation held on 30 January 2018 at the offices of Mayer Brown JSM, Hong Kong.
