This article comprises a report on expert discussions at a joint Arbitration Debate held in Hong Kong in February 2019. Organised jointly by BRG Asia-Pacific, Hong Kong International Arbitration Centre and Arbitration Chambers, its theme was Whose Role Is It Anyway? Debating the Upsides or Downsides of Party- or Tribunal-Appointed Experts in Arbitrations. The article focuses on the issues of (1) expert independence and bias, (2) managing the complexities of expert evidence, (3) party autonomy and control of expert evidence, (4) managing costs, and (5) witness conferencing or ‘hot tubbing’.
