This article discusses how the Code of Civil Procedure 2002 and the Law on Arbitration 2017 of Mongolia have, in their interaction and application, given rise to uncertainties and ambiguities in relation to the recognition and enforcement of foreign arbitral awards by Mongolian first instance courts, with associated risks and delays. It therefore suggests the need for better and clearer regulation of the procedure for recognition and enforcement by reconciling these provisions in a number of ways, in particular through the introduction of a right of appeal against decisions of first instance courts.
