This article discusses the challenges Chinese parties may face when transferring data across borders during international arbitration proceedings. It first analyses restrictions, gaps and uncertainties in PRC law on cross-border data transfer (CBDT) by reference to the requirements of relevant PRC legislation. It then explores the treatment of CBDT issues under PRC law by arbitral tribunals in the context of the IBA Rules on the Taking of Evidence in International Arbitration. Finally, it provides specific practical recommendations on CBDT for Chinese parties to international arbitrations.
