In this article, the authors promote the adoption of the concept of collaborative arbitration. Having suggested a possible definition of the term, they seek to identify (1) the essential terms of a collaborative arbitration agreement, (2) features that might make disputes suitable for collaborative arbitration, (3) advantages and disadvantages of the collaborative model, (4) key requirements for and inhibitors to workable collaborative arbitration, and (5) reasons why practitioners and arbitration stakeholders should consider adopting the collaborative arbitration model.
