This article discusses, by reference to a number of cases recently decided in Hong Kong, the parameters of the arbitral tribunal’s overriding duty to observe due process in conducting arbitration proceedings and the court’s role in preventing abuse and upholding fairness in the arbitral process. The author provides guidance on the circumstances in which grounds for challenging awards for lack of due process may lie and advises parties as to what is expected of them in initiating and pursuing such challenges. The article is an adapted version of a Keynote Address delivered by the Her Ladyship on 22 October 2025 to the ‘ADR in Asia’ Conference held at the Four Seasons Hotel Hong Kong as part of Hong Kong Arbitration Week 2025 (HKAW).
