This article was delivered as a paper to the UK Society of Construction Law in October 2005. The author discusses the role of the mediator in reality checking client expectations and the duties of solicitors and counsel to prepare adequately for mediations and manage client expectations. He also advises lawyers to take advantage of the non-judicial nature of mediation to consult the neutral privately.
