Aspiring to achieve ever greater efficiency in arbitration, several arbitration institutions have adopted some form of early or summary disposition procedure. Mapping the various terms used to describe those mechanisms under different rules, this article then discusses the BCDR summary procedure provision introduced in its 2017 Rules of Arbitration, explores its features, and reflects on the appropriateness of such a provision in the light of the broad powers typically afforded to tribunals.
