Summary disposition of disputes in arbitration is now supported by express provisions in many arbitration rules. The Hong Kong International Arbitration Centre (HKIAC) introduced its Early Determination Procedure (EDP) in the 2018 HKIAC Administered Arbitration Rules, providing a two-stage process for early determination of manifestly unmeritorious points of law or fact under a short timeframe. This article reviews the historical development, drafting intention, current statistics and tribunal decisions in respect of EDP based on the author’s first-hand experience in drafting the provisions and seeing how they were applied in practice.
