As with similar provisions in other arbitration rules, Article 6(4) of the ICC Rules gives the ICC Court the authority to decide whether, and with respect to which parties and claims, an arbitration may proceed following a referral by the Secretary General under Article 6(3). As recognized by the case law in several jurisdictions, these decisions are administrative, and not jurisdictional, in nature, even though they may require a prima facie analysis of the arbitration agreement. The Court shall allow an arbitration to proceed when the parties have submitted evidence showing that an arbitration agreement under the Rules may exist.Article 6(4) operates as a gatekeeper for the parties’ ability to arbitrate.
