The Dubai International Arbitration Centre (DIAC, or Centre) is a leading, independent arbitral institution for the Middle East, Africa and South Asia. The Centre is committed to excellence, efficiency, and diversity and, in the past year, it has implemented several changes to meet the demands of users, including appointing a new Executive Director; expanding the Secretariat and appointing an experienced Registrar and Deputy Registrar with a track record of putting users first; reforming the Arbitration Court; and adopting modernised Arbitration Rules (the Rules). This article describes the procedure and threshold applied by the Centre when determining whether it has prima facie jurisdiction to administer an arbitration and presents examples from the Centre’s caseload to provide practitioners with a better understanding of the applicable standard.
