In its already renowned judgment in Inter Acces v. Willemse, the Amsterdam Business Court in summary proceedings authorized the company’s management to issue new shares, thereby diluting the majority shareholder’s stake into a minority stake. It is the aim of this article to investigate the role of Article 1 Protocol 1 ECHR in cases like this.
