Human rights and the international minimum standard of
treatment of aliens share a common origin and a similar pedigree in the rule of
law. Like human rights, the substantive standards of investment treaties protect
individual persons or entities against specified acts of governmental
authority. That this is so does not diminish those standards’ contribution to
the rule of law.
