This contribution discusses the EU’s multilateral investment
court system (the ICS) and its promotion by the EU in the context of what is in
essence ‘fake news’ about investment arbitration. Given the problems with the
ICS, including little clarity over its precise structure, unanswered questions
regarding the likely candidates for judges, and apparent division between EU
Member States on the whole idea, the author argues that the ICS is destined to
die.
