In February 2020, the Court of Appeal in The Hague rendered its
long-awaited judgment in the Yukos v. Russian Federation cases.
These cases concern a series of awards rendered by an UNCITRAL tribunal
constituted on the basis of the Energy Charter Treaty. In 2016, the District
Court of The Hague had annulled the awards due to the UNCITRAL tribunal’s
alleged lack of jurisdiction. That decision is now overturned and the awards
are revived. This case note recalls and comments on the findings of the Court
of Appeal.
