Abstract: The structure of this annotation generally follows the order of the submissions listed by Lord Bingham of Cornhill in point 8 of his opinion in the Corr judgment. However, due to the distinctive approach to the construction of a tort in civil law systems, some of the issues that merited a separate argument by the House of Lords would have been dealt jointly under Polish law. These differences notwithstanding, a probable outcome of the Corr case before a Polish court would be similar.
