The subparagraph 15(a)(ii) of the Protocol of China’s Accession to the WTO will expire after 11 December 2016. The legal consequence of the expiry under WTO law hinges largely on the interpretation of paragraph 15 of the Protocol. In this respect, the Report of the Working Party on the Accession of China should be taken into account, which provides contextual support for the view that the expiry of subparagraph 15(a)(ii) will require WTO Members to adhere fully to general anti-dumping rules provided in the Anti-dumping Agreement and the GATT 1994 in antidumping proceedings involving Chinese exports.
