The EU introduced the EU retaliatory tariffs in response to the US 232 tariffs on certain steel and aluminium products. The EU retaliatory tariffs result in significant additional costs for EU importers, downstream industries and consumers of over 180 US products. While these tariffs’ WTO law consistency has been extensively debated (and is currently reviewed by the WTO Dispute Settlement Body); their EU law consistency appears to have attracted less attention. This article attempts to fill this gap by providing a preliminary assessment of whether the EU retaliatory tariffs have been determined and adopted in accordance with applicable EU rules.
