In Thailand, trade
remedy measures have become a prominent and widely adopted tool for protecting
Thai industries. However, judicial review of trade remedy measures has
gradually developed. Uncertainties still remain in certain aspects of judicial
review, particularly whether economic loss can be awarded for unlawful
determination of trade remedy cases. This article aims to provide development
of judicial review on trade remedy cases in Thailand, with an emphasis on the
legal principles, insight court precedents in the domestic legal framework, and
implications.
