When seeking recognition and enforcement of an arbitral award against a sovereign State, several issues may arise. For example, how is an arbitral award recognised and enforced in Spain? What are the particularities and the issues to be taken into account when seeking recognition and enforcement in Spain of arbitral awards issued against sovereign States? Is it possible to seek enforcement against assets belonging to those States located in Spanish territory? Is it possible to seek enforcement against any of those assets or are there restrictions and constraints? And lastly, can an arbitral award issued against a State be assigned to a third party for its recognition and enforcement? This article aims to shed some light on these interesting topics.
