The current government administration has shown, since the beginning, a firm attitude towards the re-foundation of Bolivia. The desire to reenact a new Constitution was successful, thus on January 25th 2009 approximately 62% of the Bolivian voters approved the new Political Constitution. The new Magna Carta contemplates a specific treatment towards arbitration in foreign investment disputes over oil and gas activities. It also determines what jurisdiction and law will apply towards other foreign investment disputes in general, hence, denoting a sense of «come back» for the Calvo doctrine.
