European Competition law is arbitrable but just partly.

Arbitrators may apply articles 81.1 and 82 of the EC Treaty but not article 81.3.

They can not request preliminary rulings under article 234 of the Treaty either, and furthermore, their awards are subject to national judicial review of compatibility with European competition law, whose scope and intensity varies from one Membar State to another.

This gives rise to various problems whose resolution will depend on the position that EU Institutions adopt concerning the role arbitration should play in the European judicial system.
