A review of recent decisions issued by Spanish courts on the support and control of arbitration has demonstrated a tendency on their part toward supporting arbitration proceedings.
The recent decisions suggest that Spanish judges have been opting to follow the modern principles established by the Spanish Arbitration law instead of those stated in the Spanish Procedural law. In fact, the tendency reaffirms Spain as a country that strongly backs and promotes arbitration as an alternative dispute resolution mechanism.
These conclusions are also supported by the Arbitration law reform bill aimed at facilitating the highest level of support from Spanish courts in national and international arbitration proceedings.
