An Arbitration Law Reform Bill was recently approved by the Spanish Government. Some aspects of the Bill have merit including: concentrating in one court the most relevant arbitral matters, and expressly establishing a prima facie standard of review for the validity of arbitration agreements. However, certain aspects of the Bill are also open to criticism, including —among others— designing an unnecessary special court procedure to invoke the arbitration agreement, prohibiting the domestic amiable composition, and deferring to the court’s discretion the decision on whether or not to hold a hearing in the vacatur procedure. This article analyzes and discusses in detail these and other aspects of the Bill, and puts forward, where required, alternative solutions to the obstacles they present.
