The main purpose of the Decree dated 13 June 2011 reforming arbitration law in France is to define the relations between the Court of Arbitration and the State Judge.
The fact that for the first time this Judge is called «supporting judge» is revealing of the will of the authors of the Decree.
Besides, this text aims at unifying petitions presented before the supporting judge, in the area of national and international arbitration, after the sentence is rendered. The principle is to give priority to actions for cancellation rather than to appeals.
In that respect, the arbitration award, if not cancelled, should not be submitted to the control of the Appeal Judge.
