Art. 8 Spanish Arbitration Law «LA» covers the judicial support to arbitration and control of the award. After the last reform (may 2011), the LA confers faculties to three different courts on this matter: «Tribunales de Primera Instancia», «Tribuna les Superiores de Justicia » and «Tribunal Supremo». Although, the latter’s interven tion is not as extense as one would desire. The importance arbitration has acquired, and continues to secure, should justify conferring the right to the Spanish Supreme Tribunal to pronounce itself on arbitration issues.
Some of these recent faculties have given rise to the question: should judges within these Tribunal specialize on arbitration? This query has arisen before concer ning different matters —commercial law or European trademark—, and the answer has always been affirmative. I think it should continue that way.
