RESUMEN
Se examina en el presente trabajo si en un acuerdo transaccional en el que las partes han dispuesto y consensuado libremente sus pretensiones, pueden también alterar a su voluntad la cuantía del procedimiento previamente determinado en la fase alegatoria, cuando elevan dicha transacción al árbitro para que dicte laudo homologado. La tesis que mantiene el autor, es que la cuantía previamente fijada no forma parte estrictu sensu de las pretensiones en disputa, por lo que, una vez fijada, deviene en un elemento objetivo independiente e intangible para las partes, a la luz de los principios de la buena fe y la proscripción del fraude procesal y abuso de derecho.
Is examined in this work if a transactional agreement in which the parties have freely agreed their provisions and their claims, can also alter at will the amount of the procedure predetermined in alegatoria phase when the transactional agreement is raised to the referee to dictate award. The thesis which the author maintains, is that the amount previously set, not being sensu estrictu part of the claims in dispute, once set, becomes an independent and objective element, intangible to the parties, in light of the principles of good faith and the proscription of procedural fraud and abuse of rights.
