In this article the authors analyse a decision rendered by the High Court of Justice of Madrid (1) dismissing the action aimed at setting aside an arbitral award issued in an ex aequo et bono arbitration with some exceptional peculiarities such as: (i) a delay of more than two years in notifying the award once it was issued; (ii) an extra round of written submissions which was not agreed by the parties; (iii) the amendment of the award through an addendum to guarantee the payment of the arbitrator’s fees; and (iv) the calculation of the arbitrator’s fees in a way which could had influenced in the outcome of the proceedings, among other issues.
