The Panorama of French case law is a contribution from the French section of the CEA, which aims to offer a review of the most recent and significant decisions issued by the French jurisdictions relating to International Arbitration. The Spanish translation of the decisions are followed by a commentary made by a member of the CEA.
The present Panorama covers three interesting topics in connection with International Arbitration. The first commentary analyzes three different decisions of the French Courts, which deal with the difficult issue of corruption and the public policy aspects involved therein.
Then, there is a decision in which, the French Supreme Court confirmed, for the first time, the criteria governing the question of legal liability of arbitrators in France.
Finally, you will find the last decision rendered by the French Supreme Court in the long running saga Tecnimont v. Avax, which, this time, does not address the substantive issues of independence and impartiality of arbitrators, but rather focuses on the binding effects of the institutional rules establishing time limits for challenging the arbitrators.
