The present paper addresses the following question: should the res iudicata prevent the review of an arbitral award adjudicating future damages time shows will never occur?. The authors comment a decision of the Supreme Court of Portugal subscribing a position they first published in 2012 (in Estudos em homenagem a Miguel Galvão Teles) defending the application to an arbitral award of the schemes originally designed for the judicial awards. Those schemes not only allow but recommend the review as a way to restore substantial justice.
