The recognition and enforcement of foreign interim measures granted by foreign courts or arbitrators is possible in Spain. If the measures are granted by foreign courts located in the European Union, EU Regulation 1215/2012 will apply (as it applies to interim measures in support of arbitration). If the court is not seated in the European Union, article 41.4 of the Spanish Law on Judicial Cooperation allows for recognition and enforcement of these measures under certain circumstances. Finally, if the interim measures are granted by an arbitral tribunal, it can be argued that the measures could be recognised in Spain under the New York Convention, as the award would be binding upon the parties and Spanish law has recently taken a new approach to the recognition of foreign interim measures.
