Today the conventional origin and the procedural effect of the arbitration agreement are unanimously recognized. This is not a theoretical issue; it has consequences to resolve many questions in the arbitration field.

Spanish 2003 law established a strong relation between arbitration and contract. The 2015 Civil and Commercial Code of Argentina regulates arbitration as a contract. This is the contract between the parties, autonomous and source of different kinds of duties.

But there are other contracts: the contract between the parties and the arbitrators; the contract of the parties with the administration institution; and the contract of the arbitrators with the administration institution.

Arbitration is a justice network that lies on multiple knot-forming contracts. It is a justice that is not integrated in a hierarchical and pyramidal logic but rather following a complex decentralized scheme which, when international, some see as delocalized.
