As regards of a request for judicial appointment of arbitrators filed before the High Court of Justice of Madrid, such Court has conducted an interesting analysis of terms “sole arbitrator” and “arbitral tribunal” by means of Judgment no. 23/2020, rendered on 23 October 2020. By virtue of the Judgment, the High Court states that, regarding an unclear arbitral clause, the term “arbitral tribunal” can refer to both a single arbitrator and a collegiate tribunal. In the absence of an agreement between the parties, a sole arbitrator shall be appointed.
