There is currently no debate regarding the question of submitting commercial disputes to arbitration, and specifically, competition and unfair competition law. This is because arbitrability is determined by the availability of the issues in dispute and not by whether or not they are subject to mandatory rules. However, in practice, we normally encounter non-contractual disputes in the context of unfair competition. In this article, we analyse the cases frequently encountered in arbitration practice involving unfair competition rules.
