This article analyzes the Procedural Efficiency of Justice Service Bill and its limited practical impact on arbitration and mediation. The aim of this law is to reduce litigation and promote the use of what it now calls appropriate means of dispute resolution. However, the Bill excludes arbitration outright from the concept of appropriate means and misses the opportunity to promote it. Moreover, the main measure it contemplates is to impose the use of appropriate means as a prerequisite for access to jurisdiction. As we will elaborate, the promotion of arbitration, mediation and the rest of the alternative means does not go hand in hand with the establishment of prerequisites to the judicial process, but with the implementation of effective measures so that society knows and trusts such institutions as a valid solution to resolve its conflicts.
