In this paper, the authors examine the legal position within the arbitral interim relief of such defendant that does not make a counterclaim against the claimant, in contrast to its legal position within the judicial interim relief under the Spanish Law. To this end, the authors analyze the regulation of interim relief in the Civil Procedure Act and Spanish Civil Case Law, as well as the Law 60/2003 of December 2003 on Arbitration and the rules of various Arbitration Courts.
