This article deals with the analysis of the potential implications in Spain of the wave of judgements by the CJEU in the Volkswagen Dieselgate scandal. According to the author and following the interpretation by the European Court of Justice, national courts in Spain (and likely in several other European jurisdictions) should award the termination of the original sales contract when they are asked to. The CJEU doctrine is “relatively approached” to the existing doctrine on performance of contracts by the Spanish Supreme Court, in areas like vice of consent, error, wilful misconduct and fundamental non-performance.
