While the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards has applied in Romania since 1961, domestic courts conduct the exequatur procedure almost exclusively under applicable Romanian law, namely Law 105/992. A party seeking the recognition and enforcement of a foreign arbitral award in Romania should thus rely on the New York Convention, but should be equally prepared to follow the more specific procedural steps of Law 105/1992. This article sketches a roadmap through the exequatur procedure in Romania, by looking into the domestic legal framework and the local courts’ practice, and by comparing the provisions of the New York Convention with their counterparts in Romanian law.
