United States Code Title 28 section 1782 is a mechanism by which federal courts within the United States may provide assistance to foreign and international tribunals and to the litigants in discovering and obtaining evidence. The nature and scope of this assistance is subject to conflicting interpretations, specifically with regard to the meaning of the term "foreign or international tribunal." In this regard, the case law in the United States concerning this statute continues to develop. This commentary summarizes the history and developments of section 1782 and considers the present state of the law.
