ABSTRACT: This article analyzes the different forms how the arbitration sphere deals with the lack of defense of the litigants. After exposing some of the arbitration principles, as well as a brief description of the litigants default in regular civil procedural law, we mention how we characterize it in the arbitration, just as its eventual consequences. We study its peculiarities in comparison with civil procedural law, as well as the different solutions to be given to the cases suggested, supported by doctrine lessons and case law.
